By accessing or using WhatALemma, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our service. These terms constitute a legally binding agreement between you and WhatALemma regarding your use of the website and services.
2. Description of Service
WhatALemma provides a digital time capsule platform that allows users to schedule messages (emails and SMS) to be sent at a specified future date and time. We act as a custodian of your messages until the designated delivery moment arrives.
3. User Responsibilities
You are responsible for maintaining the accuracy and legality of your account and content. Specifically, you agree to:
- Ensure the content of your scheduled messages is lawful and appropriate.
- Confirm you have the right/consent to contact your intended recipients.
- Safeguard your account credentials and notify us of unauthorized access.
- Comply with all applicable local, state, national, and international laws.
4. Payment and Membership
Our service requires an active membership or one-time payment as specified in your plan. All payments are processed securely through Stripe.
Cancellation & Refunds
- Membership fees are non-refundable.
- Unused SMS credits are non-refundable and forfeited upon cancellation.
- If you cancel your membership, all scheduled messages and account data will be permanently deleted on your next renewal date.
- No prorated refunds are issued for early cancellation.
5. Prohibited Use
You may not use WhatALemma for any illegal, harmful, or unauthorized purpose. This includes, but is not limited to, harassment, spamming, phishing, or distributing malicious content/viruses. We reserve the right to terminate accounts found in violation of this policy without refund.
6. Limitation of Liability
To the maximum extent permitted by law, WhatALemma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
